Los procesos de selecci\u00f3n de las empresas pueden ser muy variados, pero en todos ellos es inevitable recabar informaci\u00f3n personal de los candidatos. Por ello, esta fase, a pesar de que a\u00fan no haya una relaci\u00f3n contractual con los aspirantes, debe dise\u00f1arse para proteger su privacidad.<\/p><p>Es m\u00e1s, incluso aunque la compa\u00f1\u00eda no tenga abierto ning\u00fan proceso de selecci\u00f3n, si recibe un curr\u00edculum vitae (CV) deber\u00e1 responder informando al interesado del tratamiento que va a hacer de los datos contenidos en \u00e9l. Y es que como indica Jos\u00e9 Leandro N\u00fa\u00f1ez, socio de Audens, la normativa exige que esta informaci\u00f3n se facilite en el momento en el que se obtengan los datos. \u201cLo ideal es incluirla en las propias ofertas publicadas, o en los formularios de inscripci\u00f3n, porque de este modo se puede acreditar f\u00e1cilmente que la informaci\u00f3n estaba a disposici\u00f3n de los candidatos desde el primer momento\u201d, aclara N\u00fa\u00f1ez.<\/p><p>Sin embargo, destaca Esmeralda Saracibar, socia de Ecix Group, si los candidatos remiten su CV sin que se les haya solicitado o por otro medio que no sea \u201cla operativa oficial\u201d implementada por la empresa para ello, ser\u00e1 necesario que esta responda indicando cu\u00e1l ser\u00e1 el tratamiento de los datos recibidos. Esta contestaci\u00f3n deber\u00e1 contener, como indica Saracibar, entre otros elementos, informaci\u00f3n referida a la identificaci\u00f3n del responsable del tratamiento, los datos de contacto del delegado de protecci\u00f3n de datos (DPD), las finalidades, los destinatarios de los datos y los plazos de conservaci\u00f3n.<\/p><p>Este deber de informaci\u00f3n no implica que sea necesario contar con el consentimiento de quien env\u00eda su curr\u00edculum, salvo que la empresa decida guardarlo para futuras vacantes. En este caso, se\u00f1ala Paula Garral\u00f3n, asociada de proteccion de datos y privacidad de Bird &amp; Bird, no hay un plazo de conservaci\u00f3n establecido por ley, pero de acuerdo con el principio de calidad del dato, el <em>market practice<\/em> de las empresas es solicitar de nuevo el consentimiento de los candidatos cuando han transcurrido dos a\u00f1os, d\u00e1ndoles la oportunidad de actualizar el contenido de sus CV.<\/p><p>Las multas por incumplir estas obligaciones pueden llegar hasta los 20 millones de euros o un 4% del volumen de la facturaci\u00f3n global anual de la empresa. En la pr\u00e1ctica, precisa N\u00fa\u00f1ez, las sanciones que imponen las autoridades de protecci\u00f3n de datos no suelen ser tan elevadas.
