Incluso si se comete la falta disciplinaria, estima el fallo, el derecho a la intimimidad est\u00e1 por encima de cualquier mala conducta. Confirma la condena impuesta al empresario, como responsable de un delito de <strong>descubrimiento y revelaci\u00f3n de secretos\u00a0<\/strong>a la pena de un a\u00f1o de prisi\u00f3n.<\/p><p>El alto tribunal es tajante\u00a0al ponderar el derecho fundamental a la intimidad que ha sido vulnerado. Es cierto que el trabajador<strong> conoc\u00eda la prohibici\u00f3n de utilizar para fines particulares <\/strong>los ordenadores puestos a su disposici\u00f3n por la empresa, y que pese a ello, incumpli\u00f3 ese mandato. Sin embargo, por mucho que el trabajador haya obrado mal, el empresario no puede\u00a0acceder a los correos electr\u00f3nicos del subordinado, enviados desde una cuenta privada.<\/p><p>El trabajador en ning\u00fan momento sacrific\u00f3 convencionalmente el \u00e1mbito de su privacidad. La indebida utilizaci\u00f3n del ordenador de la empresa s\u00f3lo permit\u00eda a \u00e9sta asociar su incumplimiento a una consecuencia jur\u00eddica, pero no legitimaba la irrupci\u00f3n del empresario en los correos electr\u00f3nicos generados, nada menos que durante tres meses y en una cuenta privada.<\/p><h2 class=\"wp-block-heading\">Protecci\u00f3n de datos<\/h2><p>Se valora por la Sala que la conducta del empresario no se limit\u00f3 a un contacto casual con aquello que no se quer\u00eda conocer, sino que<strong> incluso imprimi\u00f3 varios correos electr\u00f3nico<\/strong>s, y orden\u00f3 a su hija que siguiera haciendo acopio de mensajes, lo que revela que el trabajador fue despojado de su derecho a la intimidad, a la protecci\u00f3n de datos y de su derecho al entorno virtual.<\/p><p>La disponibilidad del derecho fundamental a la intimidad y a la <strong>inviolabilidad de las comunicaciones<\/strong> no puede abordarse con quiebra del principio de proporcionalidad, subraya el Supremo, y en el caso, no existe ning\u00fan presupuesto f\u00e1ctico que permita apreciar la concurrencia de una causa de justificaci\u00f3n excluyente de la antijuridicidad de la conducta.<\/p><p>Ni la compartida utilizaci\u00f3n de claves corporativas, ni la definici\u00f3n en el convenio colectivo como infracci\u00f3n disciplinaria grave, de la utilizaci\u00f3n de los medios productivos puestos a disposici\u00f3n del trabajador, son suficientes para legitimar la grave intromisi\u00f3n del empleador en la cuenta particular de correo electr\u00f3nico del afectado.<\/p><h2 class=\"wp-block-heading\">Criterio asentado<\/h2><p>La Sala ha venido reiterando el car\u00e1cter indispensable de la<strong> autorizaci\u00f3n judicial<\/strong> para acceder a las comunicaciones personales del trabajador como \u00fanica v\u00eda posible para alzar la barrera de protecci\u00f3n que es inherente al derecho a la intimidad que consagra el art. 18.3 de la CE; y la exigencia de autorizaci\u00f3n judicial para legitimar el acceso del empresario a las comunicaciones personales del trabajador, queda vinculada a lo que podr\u00eda calificarse como el contenido material del derecho al secreto de las comunicaciones.<\/p><p><strong>Fuente y foto: Not\u00edcias jur\u00eddicas<\/strong><\/p>","protected":false},"excerpt":{"rendered":"<p>Aunque el trabajador conoc\u00eda la prohibici\u00f3n de utilizar el ordenador de la empresa para fines particulares, ello no legitima al empleador para entrar en su cuenta privada<\/p>\n","protected":false},"author":9,"featured_media":2444,"comment_status":"open","ping_status":"open","sticky":false,"template":"","format":"standard","meta":{"_joinchat":[],"footnotes":""},"categories":[14],"tags":[],"class_list":["post-2446","post","type-post","status-publish","format-standard","has-post-thumbnail","hentry","category-sense-categoria"],"yoast_head":"<!-- This site is optimized with the Yoast SEO plugin v25.6 -
